The Maroondah Planning Scheme safeguards trees and native vegetation through various Overlay controls. It’s important to note that in some instances, your land may be subject to more than one of these controls.

Under the Scheme, a planning permit is required for:

  • removal of trees within a Significant Landscape Overlay (SLO) area – note there are SLO exemptions
  • removal of any native vegetation in a Vegetation Protection Overlay (VPO) area
  • removal of any native vegetation from a property greater than 4000m2 (1 acre)n
  • removal of trees under the Heritage Overlay (HO)
  • removal of trees under the Neighbourhood Character Overlay (NCO).

If your property has undergone past development, like dual occupancy or multi-unit projects, the trees and vegetation are safeguarded by the approved plans, including landscape designs, associated with that development. In such situations, you may be amend a plan or obtain written consent of Council. when necessary.

If within a Significant Landscape Overlay (SLO), you will need a permit if the trees are:  

– more than 3m from the property 

– more than 5m in height and have a trunk circumference of more than 0.5m (measured at 1m above ground level) 

– not dead or dying or dangerous 

Exemption if an Environmental Weed species listed below: 

– Box Elder (Acer negundo) 

– Cape Wattle (Paraserianthes lophantha) 

– Cherry Plum (Prunus cerasifera) 

– Cootamundra Wattle (Acacia baileyana) 

– Cotoneaster (Cotoneaster spp.) 

– Desert Ash (Faxinus angustifolia) 

– Hawthorn (Crategus monoyna) 

– Mirror Bush (Coprosma angustifolia) 

– Privet (Ligustrum spp.) 

– Radiata or Monterey Pine (Pinus radiata) 

– Sallow Wattle (Acacia longifolia) 

– Sweet Pittosporum (Pittosporum undulatum) 

– Willow (Salix spp.) 

You do not need a permit in a Significant Landscape Overlay SLO if: 

  • the trunk of the tree is within 3m of an existing dwelling (excluding outbuildings), unless the dwelling is part of a multi-unit or dual occupancy development – then Council approval is required 
  • the tree is less than 5m in height and has a trunk circumference of less than 0.5m (measured at 1m above ground level) 
  • a suitably qualified person declares that the tree is dead or dying and has become dangerous. Council expects the person to have a Certificate 4 in Arboriculture or a Diploma or Degree in Horticulture. We recommend that you obtain the declaration in writing and keep a copy for your own records. Forward a copy to Council if you would like us to confirm the declaration is valid.
  • If tree is dead/dangerous, you will need an arborist declaration from Level 4 or above for council. 
  • If Bushfire Management Overlay, If tree is within 10m and dwelling built before Sep 2009, then no need for permits. Clause 52.48.  

SLO3 and SLO4 

Do not need permit for Removal of the following vegetation from land less than 2,000 square metres in area: 

– Chamaecytisus profilerus Tree Lucerne 

– Coprosma repens Mirror Bush 

– Cononeaster-species Cotoneaster 

– Crataegus-species Hawthorn 

– Hakea salicifolia Willow Hakea 

– Hakea suaveolens Sweet Hakea 

– Ilex aquifolium English Holly 

– Ligustrum-species Privet 

– Paraserianthes lopantha Cape Wattle 

– Pittosporum undulatum Sweet Pittosporum 

– Pyracantha-species Firethorn 

 

SLO 1 and SLO2:
